Terms of Service

These terms govern your use of toggy, a physical logging product and associated web service operated by Loggy Co. By using toggy you agree to these terms.

About toggy

toggy is a physical product with an associated web service. When a toggy disc is tapped with a phone, a unique URL linked to that toggy is accessed, and if the 'Log' button is pressed then a timestamp is recorded to a unique URL. The service is designed to help you log activities of your choosing — toggy is not responsible for what you choose to log.

Using toggy

You may use toggy for any lawful personal or household purpose. You agree not to:

Use toggy to track, surveil, or monitor another person without their knowledge or consent
Use toggy for any unlawful purpose
Attempt to interfere with, reverse engineer, or compromise the service or its infrastructure
Resell or commercially redistribute toggy products without our written consent

Your URL

Each toggy is associated with a unique, randomly generated 22-character identifier in its URL. This URL is your access mechanism. You are responsible for keeping it private if you do not wish others to view your log. Anyone with the URL can view the log history associated with it unless a PIN is set.

Loggy Co does not guarantee the permanent availability of any URL or associated log data. We reserve the right to retire URLs that are inactive for extended periods, in accordance with our Privacy Policy.

PIN protection

You may choose to protect your toggy with a 4-digit PIN. By enabling PIN protection, you acknowledge and agree that:

Loggy Co does not store your PIN and cannot recover or reset it on your behalf.
A 3-word recovery phrase is generated when you set your PIN. You are responsible for keeping this phrase in a safe place. Loss of both your PIN and your recovery phrase will result in permanent loss of access to your toggy.
Changing your PIN revokes access for all previously unlocked devices. You are responsible for communicating any PIN change to household members or others who require access.
Device access tokens stored in browser sessions may be cleared if browser cache is cleared, requiring re-entry of the PIN on that device.

Loggy Co expressly disclaims all liability for loss of access resulting from a forgotten PIN or lost recovery phrase.

Notes and tags

Notes and tags are encrypted before being stored in our database, so they cannot be read directly from it. Loggy Co controls the keys required to decrypt this information.

Authorised personnel may access decrypted notes or tags only where reasonably necessary to provide support, maintain or secure the service, investigate misuse or incidents, or comply with legal obligations.

Notes and tags are visible to anyone with access to the relevant toggy URL. Where PIN protection is enabled, the correct PIN is also required.

We may rotate encryption keys as part of normal security maintenance. We take reasonable steps to preserve access to existing encrypted data, but in exceptional circumstances encrypted information may become inaccessible.

Important notice — Medical and health use

toggy is a logging tool only. It is not a medical device, a clinical system, or a substitute for professional medical advice, supervision, or care.

If you use toggy to record medication administration, health routines, or any other health-related activity, you do so entirely at your own discretion. Because logs are only generated by your actions, Loggy Co makes no representation that logs recorded through the service are accurate, complete, or reliable for any medical or clinical purpose.

You remain solely responsible for all medication and healthcare decisions for yourself and any person in your care. Always follow the advice of a qualified healthcare professional. In the event of a medical emergency, contact emergency services immediately.

Loggy Co expressly disclaims all liability for any harm, injury, adverse outcome, or loss arising from reliance on logs stored in toggy for any medical or health-related purpose.

Intellectual property

toggy, including its name, characters, disc designs, and web service, is the intellectual property of Loggy Co. All rights are reserved. Nothing in these terms grants you any licence to use our intellectual property beyond what is necessary to use the product as intended.

Limitation of liability

To the maximum extent permitted by Australian law, Loggy Co is not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of toggy or any interruption, error, or discontinuation of the service.

Our total liability to you for any claim arising from your use of toggy is limited to the amount you paid for the physical product.

Service availability

We aim to keep the toggy web service available at all times but do not guarantee uninterrupted access. We may suspend or discontinue the service at any time. In the event of permanent discontinuation, we will provide reasonable notice and give users the opportunity to retrieve their log data.

Governing law

These terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of the ACT.

Changes to these terms

We may update these terms from time to time. Material changes will be notified by updating the effective date above. Continued use of toggy after changes constitutes acceptance of the updated terms.
